Cheque bounce

Dear Sir,
One of My Friends relative was borrowed money from me about 3 Lakh around 2 years back.In order to the return he was given me cheque with date 0f 01/02/13.While post in my account it was return back without any amount.Now i was spoke with him reg the amount he is not answering me properly.Now what i will do to take action in legal.Kindly clarify me please.

When did it get bounced?
Send him notice for repayment immediately giving him 15 days time.
There after within 30 days file case u/s 138 of NI Act.

If chq bounced within last month, issue 138 notice of demand.

you have not mentioned when the cheque was presented by you to the bank and when intimation was received about dishonour . on receipt of intimation you have to issue notice within 30 days . if said period has expired represent the cheque again . then issue legal notice

You redeposit it now, and issue notice on dishonour immediately.

if chequ e had bounced in February 2013 then you can represent the cheque . please note that cheque has validity of only 3 months . so dont delay . represent cheque and if dishonoured issue legal notice
