hello sir, this is raman mittal,customs officer..i have an query..my father is a businessman.ours is a joint family having my aunt and uncle..my uncle have no child and he is also innocent and little minded....now please tell me how our family property will be divided. we are two brothers.both are adult..there will be four parts of the property or only two parts..thanks

In your joint family as per stated by you are totally 5 members.File a partition suit through your local advocate, total property will be divided between all 5 family members.

thanks sir..but someone stated that my family property will be divided between only my father and uncle.

You have not mentioned the meaning of family property. Whether the mentioned property is self acquired of your HUF or is ancestral. This information is vital to reply your query.

thanks sir@raj kumar makkad..this is my family ancestral property..but our business is also joint.my uncle doesn't earn anything..he is mentally retarded..he has no children.we are the family of following members..my parents, my aunt, uncle..i have one brother and two sisters..one sister is married.then now tell me how our property will be divided.
