Revocation of General Power of Attorney - Reg

(Querist) 15 April 2010 This query is : Resolved
Dear Sir/mam

one partnership firm has submitted General Power of Attorney (GPA) in the name of "X" and after one years the same firm submitted another GPA in the name of "Y" stating in their covering letter that they have canceled the earlier GPA since the GPA holder resigned from job. In this circumstance can we accept the new GPA submitted by the firm or advice them to produce any supporting document for cancellation of GPA? please some one clarify my doubt

For cancelling/revoking a GPA strict proof of service of notice on the agent is a must.

You can ask the partnership firm to submit the proof of notice of cancellation of GPA sent to the agent (X).

proof of cancellation of old GPA is necessary. Proof like paper publication and cancellation notice served on the GPA holder.

The GPA executed earlier needs to be duly canceled. A notice of cancellation has to be served upon the GPA holder through a registered post acknowledgement due or by other means where there shall be proof of delivery of notice and after that earlier GPA is considered to be canceled. Until such time old GPA is valid.

I have also similar opinion in consonance of all other experts on this subject.
