a mother executed a settlement deed in favour of her younger son without any condition. later she filed an application under section 23 of senior citzen act 2007 before district magistrate to declare the settlement deed as null and void.
whether she has right to file application without any condition in the settlement deed.

Such petition for declaration is not maintainable. Only the competent civil court has got the jurisdiction to grant declaratory decree. The Act is promulgated to provide maintenance to the Senior Citizens- Parents not for making any declaration.
