Complainant Bank is not appearing before Court past 3 years. Hon'ble Court is giving dates.Accused is attending with out failure. What Accused can do ?

In criminal law, when the complainant doesnt appears for one or two dates without any sufficient cause, the case automatically is dismissed for non-prosecution.

What your Lawyer is doing?

Also you can claim compensation for the delay caused without any sufficient cause.

Apply for the certified documents of all orders of your case first and after that move petition for its dismissal and after the petition again take the certified copies. :)

Press the court to dismiss the complainant. Court could have done it earlier, since 3 years he is not appearing before the court. So press it once again to dismiss the case for default
