Dear Sir,
I have got copyright for the Logo MURASU , the symbol given to Mr.Vijayakanth's political party DMDK in the last Assembly Election in Tamilnadu.
I am using this Logo MURASU for my garment production. We will print this logo on our t.shirts. At the time of election, if we go to polling booth for voting wearing this t.shirt(which has the logo of Murasu)the opposite parties will raise objection.
I am the owner of the logo murasu and I have the right to use it on our garments.
The question is can I claim money consideration from the political party DMDK for using my logo as their symbol for their party in the forthcoming election. What are the method to sue them?
Please give your legal opinion, Sir.

Without going too much into the technicalities on the matter, I would like to say that you are living in a dream world. Your Logo 'Murasu' is connected with Garments. The 'Murasu' symbol of the party is an election symbol. The party is not using the symbol for selling any garments. In other words the party cannot be said to be infringing your logo in any manner. As such, the question of your claiming any money consideration from the political party does not at all arise.

Thank you Mr.Ramachandran for your reply . Okey Sir, The election commission did not recoganised the symbol Murasu as the symbol of state political party yet. Because Mr.Vijayakanth party has got only one MLA seat. and he should have got two seats. Further please note that only in the Trademark Act your point is correct, as per my opinion. But in the copyright act it is different, I think so.
As per your view i can use the logo murasu for my garments. Okey sir, whether the election commission has the right to prevent to wear the garments with the logo murasu at the time of polling votes or not.

yes. mr.ramchandran is exactly correct.. you just got your logo for your garments. but the logo murasu allot by election commission.. just realise the difference..
