Regarding maintanance %

Respected,

I have a serious doubt,

wife claim maintanance court granted in husbands salary but how its calculated

1/3 or 1/2 of full salary ( CTC of the month)

1/3 or 1/2 of full salary ( after any deduction like HRA, specisl allowance, variable allowance etc)

1/3 or 1/2 of Basic salary what husbands get

No hard and fast rule. But the amount should not cross 1/5th of the total income of the husband as the Calcutta High Court Rules.

Maintenance cost has no relation with CTC, but on the need of balanced maintenance amount for the spouse with reference to the income.
