thaks for your reply.... here are few details .we have drafted the consent term that we pay that party 6 lakhs once final hearing for divorce happens and they take their case back , divorce case is going on in Haridwar court and we have deposited draft of 6 laks with the court.
Now we have put the application for withdrawl of "request for stay" and are waiting for allhabad high court for either sending that case(application for stay) back to lower court ,where opposite party can take their case back or high court itself dissmisses the case on the basis settlement documents.
I have question regarding how do we expediet the hearing as it has been 6 months we are trying to get things done but every time there is new date,Even though it is not for stay any more and is just for withdrawl of "application for stay".

ASK YOUR LAWYER TO FILE A PETITION FOR MOTION "TO GIVE EARLIEST HEARING DATE" THEN IT WILL BE CONSIDERED BY HIGHCOURT. THE HEARING OF PETITION IS DECIDED ON SENIORITY AND URGENCY BASIS.

If you file your Compromise Deed before High Court and pray for disposal of all matters there than conciliation center situated therein can decide the matter expeditiously.

If the case is run in Haridwar, won't Nainital HC have jurisdiction over it?

thanks experts for your valuable advice, I have one querry. if high court is taking too much time in dealing...
1..can we still go for divorce case and get over with it, even though contract between two parties says that, money would be paid to other part once all the case will be taken back.

we apply for quashing. or moving to lower court. does court will need the presence of other party, and what are further outcomes if the other party doesn't show up..as my worry is if we she gets remarried and doesn't show up in court, Does the legal settlement contract be any good in such case.
