Sir, I divorced my wife on which she filed many cases againts me 498a, 125 and other many cases which all is applicable to favour women in india. She has taken due advantage being women and the curruption in india. We are fighting cases for more than 8 years without any compromise and even if compromise the demand is too high which i cannot bear. I m in dubai and all cases she filed when i was here in dubai. she acquiated 15 of my family members and relatives. cases proceeding is on and my father attends all cases. 3 days before it happened when my father appeared court case after that police picked him and put in jail saying there is forgery case against him for forging talaknama and that i have not signed and my father signed. i even have affidavit for talaknama from dubai consulate but the signature verification was done from my old 15 years records. she bribed police to investigate on my old records rather than the new one which in passport. My talaknama and passport signature matches and also affidavite.
the only mistake my father did he notarized the talaknama from india and submited to court. Question was raised notarization happens when person in india and forgery cases is filed against by bro, father and 2 sister under IPC 125/6 u/s 465, 468, 469, 471/34

We approached session court and judge she postponed the matter, now he is in jail. Im so much disturbed i do not know what to do. All cases are filed in delhi and her matrimonial place is in pune.

i do not understand how to bail him? is there a way out. please suggest at earliest.

engage a local criminal lawyer in delhi . did your father commit forgery ? if not you have to produce all evidenceyou have in support of your stand that your father has not forged any signature .

if you have not signed talkanama and your father has done it by forging your signature your father will have to face trial .

Thanks for opinion my father is innocent and i have enough evidence to produce. But main question is to release him on bail. and opposite party is trying to harass us in many ways. As i mentioned my ex-wife has filed many cases to harass us and influence police and other ministerial affairs just for sake of extracting more money. I have paid till today 10 lacs as maintainance and here alimony. But her greed for money is not getting exhuasted. She says to put all of us in jail...

What Notary had to say??
It is Government machinery to check identity of p[person, put thumb impression, check Photograph on Notary Papers, and he too is equally responsible, So he will help you, saying your father was not there, and someone of your age had been identified.Certainly your wife cannot be eye witness. It is her assumption.

Your father committed blunder!!, but a person can come & go also from Dubai without using Passport: Lots of instances of Duplicate Passports.

One more unlucky harassed husband !!

my father was misguided by my lawyer who suggested to attest it from notary... my life itself is blunder and screwed-up.
Consulate on her influence framed me under 10(3)b saying i m not attending courts dates and passport will be impounded. I reponded that its matrimonial case and i m not criminal and even court has not ordered any impoundment.twice it has happened now consulate has come-up with another issue when i renewed my passport in 2005 i never mentioned that cases are going against me. for which i responded any matrimonial cases never last longer and therefore i never mentioned during renewal. they said to submit passport which i refused and since 4 months i have not heard any news from consulate for what action they may take, can you please suggest what will be impact. will they impound my passport or not allow me to enter india? im confused.

thanks for your valuable advice,

At this point, the best advise available to you is to appoint a good lawyer to take care of the matters.

you pick up joke with law on multiple counts and blame your ex-wife who has jusst used the weapon provided by you. I can understand that you are not in India and someone not the talaqnama on you behalf attested by notary. Now someone is advising to raise evidence of notary that it was not your father rather someone looking to your age. Will he depose in such a way that he goes to jail? You say that a case under 498a is pending and you hide this material information from Indian authorities in Dubai and are getting passport renewed. Are you interested in having one more case against you when in India. How do you prove that you signed talaqnama in India when in Dubai. That being the case it appears that divorce did not happen.

Yes there were faults on your part and your lawyer as well.
Do engage another advocate and take proper strategy.
