Builder not completing the building

Hi,
I have purchased a flat in Platinum City, Bengaluru. As per the agreement, the builder had to complete the building and handover me the flat on 30th Sept 2011. Though I have got the flat ready internally, he has not completed the building, staircase, lift, passsage etc. There is also difference from what he had shown in sample flat to what he is finishing now. The cost is high and i am not able to occupy the flat for want of facilities to live therein with family. I have been sending him mails and he has sometimes replied and many not. Can i take possession of the flat by giving all my comments in the possession paper and then claim cost for delayed delivery of the flat and at what rate and process.

You can initiate legal action against the builder on account of all lapses even after taking the possession with your comments on the possession letter.

the agreement must be containing a clause that in vent builder fails to deliver posession by 30th september 2011 then he shall be libale to pay interest etc .
if the completed flat is differnt from what was promised then you can file complaint for deficency in service before consumer fourm claim compensation etc .
you cna while taking posession mention the flaws in construction
