Dear sir/madam

kindly advice on the issue forwarded.



My Name is Rajan dua from DELHI .

MY question is that my Father had applied for 90 Square meters Plot in DDA under Rohini Resdiential Scheme in 1979.........As My Father applied in general category and are still in the waiting List..........

1. My Father Died in 2004 and we are wanting the mutuation for this applied flat to be changed into my Mother's Name..Now the issue is, My Father purchased a different DDA flat in malviya nagar in Delhi on GPA ( GPA is on MY mother”s name)..I mean this flat in malviya nagar was not alloted to us by DDA....It was purchased by my father from the person to whom this malviya nagar flat was alloted by DDA...........

Now we have come to know that if you already have one DDA flat then you cannot have another DDA flat .......here we are confused because there are some people who says
1)DDA Clause states that we cannot apply . If one has a flat in delhi
2) there are others who says since malviya nagar flat was purchased not alloted, hence we can get the mutation of residential scheme 1979 done in our mother's name......



i would appreciate, if you could advise us does DDA has any such clause or not and if any area specific clause or what............Or main concern is to get the mutation done for 90 Sqaure meter plot applied by our father in 1979 Rohini Residential scheme to be done in our Mothers Name........... Please advise us and also since we have been waiting for this plot for the last 25 YEARS now , how can we get this plot sooner.......

Mutation can be made only if the property has been allotted. The plot in Rohini has still not been allotted so merely the intimation in writing with supporting affidavit and death certificate of your father shall be sufficient to be submitted in DDA qua change of applicant from your father to your mother.

so far as the previous flat of Malviya nagar is concerned, it is still under GPA cum sale agreement. There remain no record of GPA in the revenue or DDA record so there is no harm to keep that flat. There is the condition of not having other property in the name of the applicant for obtaining allotment from DDA.
