Excecution petition

(Querist) 12 July 2012 This query is : Resolved
Dear Sirs, I obtained final decree on property partiton suit out of compromise settelement . Based on joint compromise settelement final decree was issued . Is it necessary to file excection petition ? What is time limit to file excection petition ? Why is excecution petition required in compromise matters?
Devajyoti Barman (Expert) 12 July 2012
If the suit property is partitioned by metes and bounds then there would be no requirement going for final decree.
It is needed when the preliminary decree is not implemented.

If by final compromised decree respective shares have been allocated then no execution is required but this compromise would not be valid unless it was registered.
