Cash recovered in 420

dear sir
i have registered a FIR and accucsed were arrested n was in PCR for 4 days.and entire amount was recovered by the police station incharge.
chargesheet is also framed.

I had applied to get back money but the lower court rejected to give and i had applied in session court , session court say there is not significant proof that the notes were same notes give my you....
now my point currency notes same amount is recoverd but differnt currecy notes..

can i get back the money or it is govt property ?

Dear Rajiv
if you have any proof that your notes no. is so and so only that you can not claim the notes otherwise you have right to get your notes return because the same amount has been recovered from the accused as per you FIR.

The crux of your complaint is cheating done with you. As per Supreme Court even if police authority wishes to seek PCR for recovery of the amount the same is not good ground. The amount which you paid to the accused could not be the said amount recovered by Police while the accused was under PCR. In such circumstance the entitlement for recovery of the amount for which you were duped on the basis of supratnama is bleek. The order was rightly passed by the lower court and rightly assailed by Court of Sessions.
