(Querist) 04 March 2013 This query is : Resolved 
A working person aged 24, who drove the bike was correctly procededing . But while taking a u turn, opposite bike driven by two college students, came in wrong side and hit in a rash & negligent manner and the person who is working died on the spot. Later the two college students also died. Now the question is how the parents of the working person claim tha award as the opposite payrt alos dead. Who are the respondents in this case? Pls advice accordingly.

If student was minor with driving licence his parents as well as insurer of his vehicle would be sued otherwise only insurer would be sued for claim.Was FIR lodged?

yes sir THe FIR was logded .... and the workind deceased was drawing salary of rs.30,000 per month. And also he was likely to go abroad in promotion. So hom this loss can be compensated with higher claim sir?

In the given facts, the legal heirs have to file the petition against the owner of the offending vehicle and his insurer under section 166 of MV Act and all factors like salary, future prospects and his skill have to be mentioned therein including the fact of rash and negligent driving of college student coming from wrong side on U turn.
