I have purchased mobile through online for gift purpose and address was supplied of gift recipient not mine but the company has supplied recycled one. I visited to Police station they told me that is was deficiency in service hence no FIR but it was clearcut cheating for implicating IPC420. Then My lawyer issued notice to the address which was mentioned in the site but it was returned back with remarks "Unclaimed". Now my lawyer is saying that we have to file the suit in Consumer Court at company's jurisdiction i.e Noida. I am from Karnataka. How to get the justice in the case.

which company sent you that mobile, is it any details of communication about the warranty period. you produce the defective mobile to the local service center which is run by the manufactures service center.get the report from them by written documents . you can file the consumer complaint in the local district forum in your jurisdiction

I received the invoice wherein it was written as the recycled product but when I ordered no where mentioned on the site that they are dealing with refurbished mobile.

It is very difficult for you to establish the terms of the order. Anyway, you shall have to file consumer complaint within the jurisdiction of your area and need not to go to NOIDA as advised.

what was the value of mobile ? if you file complaint before consumer forum you will have to spend on legal fees and spend more than a year waiting for your case to be disposed of . if you can afford the time and money then go ahead
