Reg. mismatch in form 16 and 26 as statement

As per form 16 issued by the employer total tax deducted is Rs.35298 but as per 26 AS statement tax deposited by the employer is Rs.36,022.

Please advise in this case which figure I will put in online ITR 1

Income tax Department accept the figures shown in the form 26AS. You should contact your employer to rectify the discrepancy if any. Form 26AS may also show TDS deducted on the interest paid to you by your banker on your term deposits. If such is the case, take TDS certificate from your Banker also.

26AS shows only tax deducted from my salary. I have no deposit in any bank and hence no TDS certificate as 16A.

I asked which amount i.e. amount of form 16 or amount as shown in 26AS, I should put in ITR 1 for online submission.

You should mention the amount as per form 16.

Thanks Mr. Makkad. In that case may I receive any notice from the IT authorities for mismatching form 16 and 26AS ?

Contact your employer to find out and get the error rectified. As advised by you, the difference is in form 16, one of the possibility is that the TDS of some other employee was deposited in your name and yours in his account or otherwise. Such type of error can easily be traced.

If you show in your return the TDS as per form 26AS and calculate tax as per form 16 you are entitled for refund.

Better way is first get the error duly rectified before proceeding for filing of the return.

I have checked up the all 12 tax deductions from my salary slips and the the total amount matches with form 16. But Only one month's deduction in form 16 is not matching with that of 26AS. In salary slip and form 16 it is Rs.1796/- but in 26AS it is Rs.2520/-. The difference of Rs.724. The amount shown in 26AS also shows Rs.724/- more deposit compared to the TDS amount shown in my form 16.

It may be that for that particular month deduction from some other employee has been deposited to Income Tax in my name.

If it is so, now how can my employer correct the form 16 statement as it appears to me that their tax deduction amount shown in form 16 is correct. If any statement has to be corrected that is 26AS - but how is it possible ?

Now you have identified the source of difference you can get it rectified.

Your company can amend your form 16 in accordance to form 26AS. You can claim the excess amount as refund and can give back this amount to concerned employee or the company. This is easy route.

Your Company can revise the TDS return submitted by it. Hence your 26As form will show the amount as per form 16. Though this is appropriate method but associated a bit lengthy procedure.
