Food poisoning from the food supplied by railway catering service

(Querist) 19 August 2013 This query is : Resolved 
sir,
now it has become common that the passengers of train get food poisoning from the food taken from the train , supplied directly by the railway authorities.
yesterday also it happened in kasaragode, Kerala.
Now, my question is that i want to take legal action action against the railway and central govt.
what are the forums, judicial and quasi-judicial forums, i can approach ?
whether i can take legal action against the railways, even if i have not traveled in the particular train and not got poisoned ?
whether i can be considered as an aggrieved person as anyone can move the law in motion ?

An individual can always file a case before the consumer forum for deficiency of service.
In broader spectrum a PIL can also be filed.

This is a criminal negligence on the part of supplier so not only file a criminal case but also consumer complaint seeking heavy compensaation from him.

You should file criminal complaint for it. Since the matter is delayed, the sample of poisonous food would not be available for lab testing. Try to gather evidences of other passengers who were victims. Consumer forum is another platform where you can approach for relief.

As regards to claim only victim, if he has survived,or his /her legal representatives,in case victim did not survive,can file cases not any third party,whether passenger or no passenger.

PIL advised can be filed by any body but i doubt it would be entertained if adequate remedies are available in law.
