Mr. X died in Kolkata in 2010 leaving a WILL for distribution of his properties after his death.It was an un-registered WILL.Now the executor of the WILL desires to get it certified by the court.What is the cost involved for filing an application before the appropriate court excluding lawyers fees to get the probate?Does the stamp duty payablke for the above purpose depends upon the present market value of the property?

it would depend upon market value of property . maximum court fees for probate in maharashtra is Rs 75000. check with local lawyer

The cost of probate varies according to the property’s value mentioned in the will. Chatterjee says, “The court appoints a valuer to assess the property’s value.” However, there is a maximum limit to the probate cost and in West Bengal the limit is Rs 50,000.
