Tenant not playing rent and not vacating house

Hi
I have a property in Chennai. Our tenant had come up with a list of things to do in the house early this year and I had told him that i'll do it once some personal issues at house are settled. He got irritated that his work is not being done immediately and used abusive languages. Post which we asked him to leave in May 2013. He told he ll vacate in October 2013 (till when his entire advance was adjusted). Now he has overstayed and not paying the rent. When we send sms and go inside the house, he does not let us in. Does not answer SMS. However, he is telling he'll take us to court. I dont know for what reason he can take us for court? For want of some compensation? Our rental agreement expires in February. What should we do? Approach any court? lawyer? Please help urgently. Thanks

Thanks for your replies. But isnt there anything that i can do without paying a lot of money on this. I know there has been nothing wrong on my part. But i dont want to get into a case which takes a long time to resolve!!

Try amicable solution, if this does not work, legal action is the avenue left.

The house rented by you is flat or individual house. If it is flat the associations could help you. Other wise seek the help of some good local V.I.Ps who could advise them properly or the final solution will be only legal. consult a good lawyer

If your rental agreement expires in February,wait until then and issue him a notice to vacate the house declining to extent the agreement, failing which you may drag him to court.

You have no other option but to approach the rent controller for the vacation of your house. It hardly takes a time of less than 2 years to decide.
