This query is : Resolved
Sir/s,
I am a senior citizen, I had filed a complaint with District Consumer Forum against a builder for allotting lesser residential premises. The District Consumer Forum dismissed my complaint.
I have now filed an appeal with the State Consumer Commission against the order of the District Forum.
I request you to inform me the procedure at the date appointed for the hearing:
As I shall be appearing personally, shall I file a written statement with the State Commission? or Shall I have to orally argue my case?
I shall be obliged for the guidance.
Thanking you all in anticipation,
Senior Citizen

You can appear personally or through lawyer by filing an Appeal Petition.
Any person aggrieved by an order made by the District Forum may prefer an appeal
against such order to the State Commission within a period of thirty days from the date of the order.

Mr./Ms. Senior Citizen,
1. You are putting this annonimous querry which is not entertained, this platform is providing free service/ contributing for the cause of society, therefore,be specific.
2. For procedure to file appeal before state consumer commission is given in the Act, please read or engage a local lawyer.
3. You can appear personnaly if you can handle/proceed properly.
4. Otherwise I am sure that you will spoil your case, better to engage a local lawyer in your own interest.
Best of luck

yes, do as advised above.
There is no provision to make oral submission only unless you file memo of appeal.

ALL EXPERTS READ CAREFULLY"I have now filed an appeal with the State Consumer Commission against the order of the District Forum"
So filing appeal hv no issue.
Sr Citizen advised to file written arguments ,with citations now. He can argue orally, but it is preferred that you file Written Arg, after getting it approved by experienced Sr. consumer p Advocate, [in case u insist to argue in person.]

Sir/s,
My Thanks to all Experts, I am sorry if I was not clear, I shall enlarge on my message:
I have already filed an appeal with the Maharashtra State Consumer Commission, I have been called in the first week of January 2014 , and have been given a temporary registration number, subject to admission.
I believe I can argue my complaint.
What I requested was to know the procedure, whether I have to argue orally in favour of my complaint or I can put written arguments before the commission.
It will be a great help and I shall be obliged if favoured with relevant practical information.
Thanking every expert in eager anticipation,
Senior Citizen

You have to argue orally.
After conclusion of argument by both parties you are free to file written argument.

Mr. Senior Citizen, you may present your written arguments and may highlight a few aspects contained in the arguments very briefly by oral arguments too, especially the contents concentrating the facts upon which you vouch your present appeal.
