ajay sethi (Expert) 09 January 2014
please read terms of your appointment letter . it would contain clauses as to termination
Adv. Chandrasekhar (Expert) 09 January 2014
If in the organization there are more than 100 employees, then 3 months' notice or notice pay in lieu of notice alongwith 15 days of wages for every year of completed service is legal rquirement. If the staff strength is less than 100 employees, then instead of 3 months' notice one month notice or notice pay in lieu of notice along with 15 days of wages for every completed year of service is requirement. It overrides the the provisions of appointment letter provisions. Further, if employer terminates like that he should first terminate the junior most employee in that particular category. If employer terminates on the allegation of misconduct, he has to hold departmental enquiry and prove the allegation before termination.
