Acquitted from ipc 420, 417, what next?

(Querist) 16 January 2014 This query is : Resolved
Sir,

I have been acquitted from the case filed against me u/s IPC 420, 417. It was a false allegation by a woman that I cheated her money. The charge sheet was filed two yrs after the FIR. The complainant did not appear in the court and the two witnesses were also false. All the court proceedings happened within a year and 12 hearings. I feel happy to be acquitted.

Now, I have few questions.

1. Though there is no evidence against me, can the case be reopened. Is there any time limit for the complainant to appeal.

2. How to obtain the true copy of the judgement. My advocate says it is a big process and needs more money to apply, which I believe is not true.

3. Can I apply to govt. jobs?

Regards,
Sanju

1. Appeal against acquittal is possible.

2. Pay the fee to the Advocate and get the certified copy.

3. No problem.

Yes appeal can be filed in prescribed time. When the complainant did not turned up there seems to be minimum chances of appeal.

You yourself can apply for copy of decision on prescribed format and paying nominal fee / affixing court fee stamp. Mostly Format is available in some shop in court compound.

Appeal can definitely be filed but the chances of its success are minimal and certified copy of judgment should necessarily be got obtained by you which shall require the money less than Rs. 100/- (Rupees One Hundred only).

Moreover, the process to get the certified copy is very very simple. It can be got within 2 days after submission of the application. Even you can directly apply it.
