I had filed a police complaint for a cheating case. since no action was taken I filed an RTI.

Pls advise what is the option for me in case I do not recv any reply of my RTI application. Till date I have not been contacted even though I had given my contact number.

No PIO will reply you over phone.If you had applied properly by way of petition affixing required court fee stamps or pay order and the authority to whom you had applied comes under RTI you would get an official reply with in 30 days.

If you do not receive any reply from the PIO, even after 30 days on receipt of the RTI appln, you can file the 1st appeal under RTI Act.

If no action is taken by the police on your complaint, you may approach higher officials of police. You may file complaint direct in the court u/s 156(3) CrPC.

You should file appeal to appellate authority if reply of RTI is not received in stipulated time.

getting to know about the status of your complaint is different, however you can approach a magistrate court with a petition u/s 156(3) of Cr.P.C seeking direction to police for proper investigation and register FIR if necessary.
