Dear Lawyers
I am seeking advice on matter related to fake certificate issued by the Chevrolet Dealer of my purchased Beat LT Car in Jan 2013, at the time of purchase the dealer issued me a Sale Certificate having a manufacturing date of Jan 2012, recently I got to know that by decoding the Chassis number, one can know the exact manufacturing date, when I decoded my chassis number I found that the Manufacturing Date was found to be of March 2011, and not Jan 2012, when I contact General motors head office last month about the Manufacturing Date of the Beat Car they confirmed me through Email that the car is indeed a March 2011 make, whereas on the sale certificate the dealer has mentioned Jan 2012. I also filed a RTI with SDM office and have got a copy of the Sale Certificate,
on the above subject matter I need advice on following:
1) The RTI reply I have got is a photocopy and it doesn't bear any stamp or sign of the SDM office, is it possible for the dealer to get the sale certificate changed from the SDM office ? (The Sale Certificate is a computerized statement not a hand made)
2) what relief can I expect if I file a case with ONLY the Consumer Forum, is it greatly possible that I would only be compensated with some amount of money RATHER then a Brand new Beat Car ? obviously I want a Brand new car.
3) At the time of purchase of the car there was a cash Discount of 50K and others, the discount totaled to around 80K, how to present my case to Consumer forum ? as the news paper that beard the Advertisement of 50K discount didn't mention that an OLD manufacture car will be sold.
4) Whom all should I make party, as the signature on the Sale Certificate is of some employee, whose name I am unaware of, whom all should I make party ?
5) Is there a judgement by Supreme court such - when a customer is asked to Sign a large number of documents by a car dealer or a seller, it is not feasible for the customer to read all the documents and he signs those papers in good faith. I will require this judgement number / date as the dealer has verbally said that I as a customer have signed the acceptance of March 2011 model, of which I am totally unaware of.
6) Should I fight the consumer case myself or should I prefer an expert lawyer ?
Please also tell me how much expense I will have to make if I file the case myself and please give me a small brief on how to file the case.
7) Very important one - What concerns should I remember to mention on the complaint filed with the consumer forum and what should I not mention.
8) Can I expect a greater compensation if I file a complaint with Criminal Court also ? and under what sections can I expect a case to be filed ?
9) I want a Brand new latest model car and for that will a complaint with just the consumer forum suffice or I need to file a criminal complaint as well ?
10) LAST - I am in doubt that the dealer is involved in such frauds with many customers can I file a RTI with the district Transport Registration office to get General Motors - Cars sale certificates which got registered with the office ? Someone informed me that you need to have the car registration numbers to apply for RTI, can't I apply RTI just by asking - Required Sale Certificate Form 21 of the cars sold by General Motors in the city ?
