Ipc 420

(Querist) 13 January 2015 This query is : Resolved
My cousin had been accused in IPC 420 in the year 2012 and he is out on the bail, but in terminal two years case does not proceed to the court since police have not filled the charge sheet till date. When we fitted the case status on the web site of the respective court it shows 'case disposed in the nature of contested judgement' but now he has been named by the police for investigation. Now catch is if the case is thrown out then why the police are addressing for an investigation and are there any chances of rearrest in the event.
What next?

Pertaining to above case, police has called him since they want to submit a charge sheet in the court. They are also asking him attendance diary for last two years. But he was attending police station for 7 months later respective IO said now it is not mandatory you to attend the police station. And now they are asking such diary?
What will be further process now?

1. Before the Police files the Charges Sheet file n application for quashing of the F,I,R. as the matter was disposed as mentioned by the order.

Thanks Sir, need to know, can these cases settled outside court?
Devajyoti Barman (Expert) 16 January 2015
If the case is under investigation then how could it be disposed on contrast and in so hurried manner?

It appears the order shown in the website is not rightly written. Take certified copy of the same.
Both the parties can go for mutual quashing.

The information found in the website cannot be relied upon hence better to visit the concerned court office and get the issue clarified in person. The police will be right that without filing charge sheet or not being taken up by them the case cannot be disposed, verify.

Thanks experts, I have query in mind. Can this matter sorted out outside the court? Or we have to apply for quashing of FIR?
