Father's harassment of mother

(Querist) 12 March 2015 This query is : Resolved 
1) I am single(28yrs, employed) currently staying with my mother looking after her.

2) My father(64 yrs, retd., but employed again on temporary basis) has left us in 2012 and ever since started staying alone in the rent portion in the 1st floor of the same house(his own).

3) Even when he was staying together, he would often abuse(sometimes beat also) and ill-treat my mother along with his mother and sisters in various subtle ways.

4)Is my mother entitled to his pension. How can she get justice? Is he punishable?

She has to make a representation to his office people, if it is a government organisation and apprise them of her difficulties and dependence. Then some arrangement may be made.

your mother can claim maintenance from her husband under section 125 Cr Pc

Your mother should claim maintenance through court and prey to order / instruct the pension paying Bank to deduct allowed maintenance amount from pension and credit the same to your mothers account.

Some Doubts:
---------------
1) Since we are staying in his own house in the ground floor and he in the floor above us, is it possible for him to deny my mother the compensation claimed by us on the ground that as he is "compassionate" enough to allow us to stay us in his house he need not pay anything to her.

2) Also can my being employed be cited as a reason by him to deny the compensation saying that since I can look after my mother financially, he can abandon her!!

3) Apart from pension, can we file a case against his mother and sisters who have abetted or connived at his separation from us, in spite of my mother's unwarranted grovelling apologies to him and them made several times(although not a word of apology or remorse from their's side till now who are the actual offenders)!
