Applicability of mvat for period agreement dated 2007

I had registered the property in Dec-07 at Rs. 30 lacs and received the possession in Oct-08. The developer after 7 years has raised a demand of Rs.3.50 lacs towards MVAT.

I wanted to know that whether he has any right to claim the MAVT from me. If yes, as this being the first reminder to me, can he also claim the penalty levied by the state government from me.

What action should I take to revert to the letter received from the developer.

This is a case clearly barred by limitation hence the builder cannot demand the same from you now at this stage. If he has sent a notice, you may repudiate his claim in your reply notice.
