Os filed & issues not framed

(Querist) 12 December 2015 This query is : Resolved 
Dear Sir/Mam,

I have filed OS in city civil court in Jul'13 & since then court gave 10 dates.
I did not go to court on those dates as per the suggestion of my attorney for the reason, issues are not framed by the court. However, court has been mentioning in their records as no representation. Will this be a problem for me. Is there any method to fast track this case
Please advise.

Prima facie, your advocate has been less than professional. Engage another trustworthy advocate. You may bring the matters to the notice of the Bar Council.

You or your lawyer should have attended the court on date of hearing.

In civil suit expect on the date of evidence there is no requirement for the litigant to visit the court and may be that is why your lawyer asked you not to go to court.
But that does not mean your lawyer will not put representation Find out who was absent, your lawyer or their lawyer.
Since the case is still alive it means your lawyer was present but their lawyer was absent.
On next date file ' suggested issue' to fast track framing of issue.

Even though you have engaged a lawyer, it becomes your duty to to visit the court on any or few hearing dates so that you are updated with the developments.
Even now there is nothing wrong to visit the court office in person, see the adjudication of the previous/last hearing yourself from the court diary and be satisfied about the status personally.
