(Querist) 13 January 2016 This query is : Resolved 
A person was convicted under DP Act and fined. Few months later he was again convicted under same act for similar offence, however, on deciding the quantum of punishment he pleads that he has never been charged with similar offence as a result escapes fine. What can be done to prosecute him

Now as he has already been convicted and the judgement order has been passed.. you can go for appeal if you want to challenge.

Whom to appeal to. This was before a MM. Incidentally the I.o in both these happens to be same. The process for complaint against public servant. What sections are applicable

A person convicted by a Metropolitan Magistrate or an Assistant Session Judge or Magistrate of First class or of the Second class may appeal to court of sessions.
