Mr.Babu, in such circumstances,u have to make an application to concerned Judge, accompanied by an affidavit of plaintiff by stating such fact for return of such court fee,and on pursuance of the same court will issue a cheque on the name of the plaintiff for such court fee.there ends the matter.

You should make an application to the Superintendent of District Judge citing the whole facts and seek permission for withdrawal of such court fee deposited in advance to file a case which could not be filed or state clearly the whole facts. Permission shall be granted after due enquiry of record and then treasury office/bank shall get it refunded as per rules deducting some portion of it.

No it cannot be paid in another court case in the same dist., every court have got their seperate account NO., and the amount paid in the bank will be credited to the particular o/c only. You have no except withdrawing the amount.
