Sir....
The FIR has been registered on the direction by the HC under Sec. 482 of Cr.p.c. subsequently the police registered the case and subsequently referred the case as civil nature. Protest petition filed by complainant, sworn statement recorded, witness also examined. Accused wanted to pass an order in the referred police report specifically before further proceedings.
Sir, The above procedure adopted by Magistrate is correct or not?

Yes. This is the only procedure adopted by magistrate in this case. Now after taking all the evidence the matter shall be considered and if found appropriate, the notice to the accused persons shall be sent.
