negligence by a Doctor in surgery

A doctor make abdomen surgery to operate goal bladder. Doctor lef his seizure in the abodoment of the patient.

What action the patient can take agianst docotor both in criminal and in civil.

In civil action, he can c,aim compensation as well as cost of treatment through consumer forum or through civil court whereas in criminal side generally police do not file FIR against doctors especially from the day SC has declared that until and unless the negligence is proved by a senior penal of experts doctors.

1) its s case of deficiency in service you can appraoch the consumer forum

2) you can also file a case under tort law as it is a tort

3) you can also file criminal case

4) you can also complain to Medical council of India
