Signatures forged on Application form of Broadband connectio

Dear Experts,

I have a query. Recently i took a broadband connection. The executive asked me for one photo, and self attested copies of electricity bill and PAN card copy. Now there is issue with the billing as they put me in different plan. Now when i inquired the company showed me the application docket in my name. In all the documents the signature are not mine but FORGED. Only the Pan copy given by me to the executive was there in the docket with my signatures. Rest all the places somebody else has signed. Total of 4 places my signatures have been forged. And every signature is different from other.
Issue is i had opted for different plan and because of these documents (which i did not know) they have put me in different plan and sent me BIG bill.
I need to know what are my legal rights in this case against the company and the executive( who possibly had put fake signatures). Please advice.

if you did not sign it, why did you use it?

you are only differing on plan being different.

it appears that you are not disputing connection was not applied or your line was misused, but only billing being higher, which means you agree you took connection.

forgergy, if any, here appear to be with your concurrence and you used connection.

pay up and correct the plan, if amount is meagre

if in lakhs, file a criminal complaint, but weak case because you agree to using connection

Yes i am not denying for the connection. I had asked the executive for Plan A. I never knew that he will say me Plan A and will put Plan B on application, all by himself. I had asked for the application form also but he postponed it and never gave and then didn't took my calls.

He said me one thing and put the other in application form and signed it by himself.
Please tell me as this is cheating on his part then also i will have to pay for it?

your signing and giving blank application form does not provide relief to you on forgery.

why did you not check on the form before signing?

can you prove that you wanted a different plan than what is on the form? video graphed whole signature episode?

i think by asking a wrong question, you are violating first rule of litigation.

you must come with clean hands

you must pay and correct prospectively only

Thanks for your continuing help.

But I would like to clarify that i have not signed a blank application.

I only signed on the photocopies of electricity bill and PAN card.

He filled the application form and signed it by himself without my knowledge. Also he did not use electricity bill given by me but took a printout from internet and again signed it by himself. That is why all the signatures are different.

This is why i am asking because on the form itself, fake signatures are there and not mine.
I hope i cleared myself. Pls advice.

Issue notice to the dept., for playing unfair trade practice with you. Unfair trade practice also comes under the consumer act.

These braodband people are doing like this as a routine since with imminent 3G rollout no body will ask them so they want to get as many customers as they can get by hook or crook. Since you have paid for the device and if till todate you can forgo it, just ask them to disconnect and take another cheaper connection. There is heavy competition now.

conceding that there is signature difference signed by executive.

who is he? employee of BSP or agent?
how many months bill you had problem?
what is the quantum involved?

these would be criterion to decide your course of action.

I agree with adv.rajeev, it will be deficiency of service if you can prove no acquiescence and first month bill you are contesting. in which case i belive differnce will be not more than 2thousands

if not you continued for 6 months 1 year, there are chances of doubts.

you could also file criminal complaint, but first get your document copies with that department officially given to you on request or by RTI and provide evidence of forging signature to bill you more.

I believe he is agent from a service company, who give service to this BSP.

how many months bill you had problem?
I am contesting for first bill which is of hardly 8 days and yes bill is 2000+ (ideally it should be around 150).

I had put complaint through email and they sent me the scanned copy of all documents, where i found that signatures have been forged.

I am now writing them detailed reply page by page of documents where my signatures have been forged by the executive and considering his unethical trade practices and should correct the amount.

I hope they agree and correct else i will have to go legal way.

I hope my course of action is right. Pls suggest.
