About WILL

Querist : Anonymous (Querist) 23 July 2010 This query is : Resolved

One valid WILL has already been revealed and property transactions have taken place based on that WILL thinking that this was the last WILL of my father. Now after a time gap of four years after the revelation of earlier WILL another genuine WILL of later date was revealed by my sister.
Is there any time bar to reveal another WILL if there is another valid and genuine WILL which is dated later than the earlier WILL?

In the eyes of law untill the will is not got probated (after inviting objections from the concerned legal heirs etc.) it does not attain finality. Secondly for the purposes of genuineness the question of registered and unregistered will also important for the purposes of getting it probated.

Best Regards

There is no time for revelation of the latest will. If probate has not been granted in respect of the previous one then go for probate of the subsequent one or else have to file a suit for revocation of the probate already granted.

U have not stated whether probate of the 1st Will has been taken. On what basis is the 2nd. Will being considered as genuine? Question too theoretical bordering on absurdity.
