Dear experts,

query related to society act and powers

my neighbour has grab the corridor place by taking the consent of only four people only.

is it possible to by law/ power of society act to secratery/ chairman to change the structure of the premises .

if anyone with an intention to harrass neighbours , changing the place of their of their main gate forcibly.

in such a situation what remedy one can take.

Such sufferer may file a civil suit and may obtain stay order against any of such alteration.

his act is not lawful. as advised by Shri raj kumar Makkad, you can file civil suit and obtain stay order.

Normally suit may not be with in jurisdiction of civil court when the dispute is found between members of a co operative society or with a member at one end and society at the other,if such become the case you will have proceed before registrar.

Society matters are first to be taken up within the society and should be reported to the decretary of the society to take necessary action, if something goes wrong within the society premises. If the conciliation efforts fail that should then be taken up with the Registrar of Societies. Recorse to the civil suit should be preferred only exhausting both the channels.

common areas like corridor belong to all members . the society cannot grant any permission to any member to encroach any common areas . society has no powers to do . you will have to complain to local muncipal corporation against said encroachment and they will demolish the same on recipt of written complaint from any member of society .
