Interim maintenance!

In a maintenance case u/s 125 of CrPC in family court–

- What are those minimum ingredients, the complainant/Petitioner (Wife) has to place before the court to get the order of “Interim maintenance” in her favor?

Any Historical Judgment which can be used as "WEAPON" to prevent any interim relief to the wife whose hands are not clear (I mean tainted) before arrival to the COURT?

What do you mean by "TAINTED"?

If a wife has not sufficient means to maintain her, she is entitled to claim for the maintenance interim as well final.

It is the bounden duty of the husband to maintain his wife.

No amount of effort is going to help you to avoid her maintenance unless she earns at par with you.

INT MTN, THOUGH ALLOWED, IT MAT NO BE ALLOWED TOO, IF HUSBAND FILE AFFIDAVIT THAT HER INCOME IS MORE THAN SUFFICIENT TO MAINTAIN HERSELF.

If arrange to produce Salary certi, + ur Aff, u can avoid Int Mtn

you can avoid maintenance only on ground of that she is able to maintain herself from its income.

If she is unable to maintain then husband is under legal duty but if husband proves her earning sufficient as per standard of husband or even above husband then court may absolve him from this duty.

For Interim Maintenance, there is no examination of witnesses. If you want to avoid Interim maintenance, no one have to be in witness box to prove her income. You can take full advantage of it, Final Maintenance will be after few years. Till Then time changes!!
Nothing wrong trying it. You do not lose, anything at the moment . Think it over..
