Admissibility of affidavit in criminal case

sir

1. In a criminal case, before trial court, application for condonation of delay u/s limitation act filed. In evidence we filed affidavit with document.

There is objection from other party.
whether affidavit is admissible in criminal proceedings when deponent is ready for cross examination.

Law of Limitation is applicable even in criminal case so if the application especially with no objection from the opposite party is filed, the court is bound to allow it in the interest of justice.
