Probate fee on chs flat

Hon.Experts,

I am a senior citizen of 83+ years, I have a query:

I have an ownership flat held jointly with my wife, my name appears first in the share certificate and the registered document. My wife demised several years back, we have no issues.

I want to Will my flat to my niece who has been looking after us for a number of years.

I would request the experts to inform me whether any court probate fee is payable, on my demise, for transfer of the shares/flat, by the nominee/beneficiary of my Will.

if your neice applies for probate of will then maximum court fees in mahrashtra is RS 75000 for probate

One more query, is it true that for a probate on a flat owned under co-operative ownership basis, the percentage of probate fee is considered on the value of the share certificate and not the value of the flat?

there is a judgement that court fees would be on value of share certificate and not value of flat . i am unable to lay my hands on said judgement of bombay high court
