Mr A and Mr B jointly deposited amount with builder and executed agreement. Builder given cheque in refund of booking amount in name of Mr A only. Cheque was bounced. Notice given by mr A but no result. Thereafter Mr. A gone abroad. Now whether Mr B can file complaint because he is also party to agreement and have full knowledge about the deal. Whether complainant name would be Mr A, the name of payee of cheque or may be Mr B . Please advise.

B can not file complaint as he is not payee.ccomplaint can only be filed by A .If A has been gone to abroad then A can execute power of attorney and power of attorney holder can file complaint on behalf of A.
