Share in a parent's property

Guest (Querist) 25 February 2011 This query is : Resolved
Sir, I am recently married in a poor family because my father did not want to spent money on me since i am a girl while he has a huge property. I have 3 working brothers & 1married sister. They also do not want to give anything to me. So i want to know 1. Is there any share for me in my parents property? 2. If yes, how i can get that? Kindly suggest me.

You have share in your father's property during his lifetime only if those properties are ancestral properties. If not then you can claim.
After the death of your father if your father did not gift or execute any Will bequeathing his properties to certain people only then you have equal share in it with your brothers and mother and to lay your claim on it you have to file a suit for partition.

If the properties are ancestral properties they you can file a suit for general partition and seperate possession of your share in your father's share. In view of the recently amended Hindu succession act you have got equal rights.

If the properties are self acquired properties of your father, he has every right to alienate, transfer, sale or dispose of any manner as he wish during his life time. He can make will in favour of any person as he wished. but he he died without any will, the all the properties will be shared by all legal heirs equally. If the property is ancestral, you have right in the property eben during the life tome of your father and you can claim your share.
