Compensation during divorce proceedings

Querist : Anonymous (Querist) 17 March 2011 This query is : Resolved
Hi,

I'm going to apply for divorce from my husband.

But can i claim any compensation from him.He doesnt have any properties or any other assets in his name. His father owns lots of properties which he got from his own earnings.

Can i claim any compensation from my husband, since he is living only on his monthly salary. Is there any possibility that i can demand my husband to get money from his father's property????

Pls advise me..i hv a son who is 5 yrs old..can i take custody of him,and also will my husband provide any financial support for my son,i'm a working lady.

yes you can file a case for the maintenance for your child. mother can take the coustody of the child upto the age of 5 years only. this is for your information you can receive a part of salary from your husband only and no one others.

Only under 125 Cr.P.C you can ask maintenance for you and your son even after divorce. Your son can claim his rights on ancestral property after growing up.

even you can file maintenance for you as well as for your son as if you not able to maintain both with your meager salary. File application for divorce and interim application for maintenance which will make him pay to contest the case. His salary can be attached
