Hello Sir,
Me and my wife ( raiding on 2 wheeler) met with an accident with 4 wheeler on 25th Oct 2010.
Wife was seriously injured and she got operated .
Case is registered and car driver accepted his mistake and case got closed by March 2011.
Due to some other issues we did not claimed our expenses with his insurence .
Can we claim now - if yes, what is the procedure .
After accident - to claim our expences what is time period to apply our claim.

There is no limitation to file claim petition under Motor Vehicle Act. You shall have to engage an lawyer and shall have to provide him all necessary documents like Certified copy of FIR, Report under section 173 Cr. P C, all medical & treatment bills, salary certificate of your wife, hospital admission and discharge certificate, your DL, RC of your vehicle, complete details of driver, owner and insurance company (if you come to know) of the offending vehicle and next follow him.
