One time settlement

my wife had filed maint under crpc 125.
2yrs gone and this drives me crazy.
I felt it is worth to prolong as no glimpse of reuniting..hence proposed one time settlement to kick the misery once for all. she has agreed and informed judge too.
the proposed wealth and money will be given in her name and the other 3 major daughters..
my doubt is if the divorce will come automatically now . and if this goes thru, I am fully relieved from the torture.
how does the process take place in this case?
May any expert shed more details on this query?

there is no procedure for automatically divorce in Hindus, or any other community.

The settlement would not make the 125 case settled out of court. In the withdrawal petition your wife may mention the amount of settlement.
For divorce both of you need to file a separate proceeding for mutual divorce. Similarly in the mutual petition for divorce both of you need to mention the amount as full and final amount for alimony for your wife.

File MCD and mention the amount for permanent alimony and for your daughters in that petition and do as desired. 125 petition can be got withdrawn simultaneously at that time with the reference of settlement.

You both need to file a mutual consent divorce petition after withdrawal of 125 petition where in all things may get settled as one time alimony and a decree of divorce would be passed .
