Regarding service tax payable against house

Hi,
Sir I have book the flat 1.5 years ago and have paid complete amount to the builder on the date of booking only for getting benefit on the rate of flat. ex . if Rate was 3400 then by paying full amount he gave me 2900 per sqft. Now after 1.5 year still the building is under construction. i have already paid the amount of my flat but want to go for registration after getting him completion certificate. So that i need not to pay him Service Tax. Builder is forcing me to pay Full service tax. Do i need to pay him service tax if i have not yet registered the Flat ? . if i will resister my home after completion then should i give him service tax as i had already paid the full amount of my flat(which is under construction) 1.5 year ago. ? Please give me the answer of this query .

Since you are going to register the Flat now only, service tax becomes applicable as per the present laws. You have to pay the same.

Ranganathan Sir, I m not going to resister my flat now . I have paid all the amount of flat but want to go for registration after getting the completion letter after 1 year. now the building is under contraction.
In this case do u need to pay him service charge.

Service tax is payable only after handing over the possession of the property in question.
