Property settlements

(Querist) 22 September 2013 This query is : Resolved
The trial court has sent notices for property dispute to all the parties in the family by various means; post, etc. The trial has started and all the parties are attending the sessions as per their dates and hearings.
My query is that the court has not sent any declaration so far, so, will it still remain a valid judgement?
Kindly confirm.

Thanking you

What declaration you are referring?

when the notice is sent out to the parties then after that summon declaration is given by the trial court. If the proceedings/hearings start without giving the summon declaration and the final judgement is passed, then will the judgement be called as valid. Also can a party reopen the case and reclaim against the given judgement on the basis onf summon declaration not being passed by the trail court.

Pls advise
