No. The information of death and the particulars of the legal heirs can be furnished to the court by any of them. But it is the duty of the appellant to implead those legal heirs in the appeal.

I differ Mr Subramaniam. There are hundreds of case where plaintiff substitute the defendants when he dies. There is no dearth of precedents either.
