Hi all,
I have taken up a MBA Course from ICFAI University. I have enrolled to this course under a EMI mode with a down payment of Rs 10,000 as a admission charges. Due to various reasons i had to withdrwn the admission for which i was asked to sen out an email & provide the stop payment instruction to bank. I have done that accordingly. However, cheques were presented for clearance & an email as well as notice ( by registered post) sent by university for every dishonored chq. Perhaps i have repled to all the emails received.
Now, i have been getting a threatning call from them that i should come down for an settlement by payment 2 months instalment or i would need to face the legal consiquences.
Please advise on my further actions

file a complaint against the persons/college for threatening you.
In my opinion it does not attract the criminal proceedings u/s 138 of NI Act because non payment of fees is not a legally payable debt.

If the cheques were presented for the fees payable by you, for the period you already attended, cheque bounce case is maintainable. But, as long as there is no notice from them, dont worry.

You can send a letter to the University stating that you have advised them about discontinuation of your studies and on their advice you have sent email to this effect and gave instructions to the Bank to stop payment of cheques, as such you do not any financial liability. You need not go for any settlement. These are arm-twisting tactics adapted by some institutions.

Agree with Mr. Jaggarao. Send a letter to the University and also file a police complaint against the persons threatening you

Dear All,
Thank you all for your timely advise. The University has Instituted a Criminal case against me ( SR No 10363 of 2010 on the file of III Additional chief Metropolitan Magistrate, Hyderabad under the section 138 of Negotiable Instruments act). Hence i would request your advise on my next step towards the same. I have received this notice by Regd Post on 25th Mach, 2011.
I feel i would need to get in touch with any Lawyer so that i could reply them legally with record. Please do refer me a suitable lawyer for the same.
