complaint under section 138 of N.I. Act

Dear Sirs,

Can you please give me the proforma for filing a complaint u/s 138 of the N.I. Act. Should the originals cheques and agreement be enclosed? Thanks.

Ready made petitions will not help you. It has to be drafted based on the facts.

Originals has to be filed at the time of filing.

draft depends on the facts of the case. Instead of producing original at the time of filing complaint you can produce the xerox copiey of the cheque and at the time of evidence you can produce the original.

on filing the complaint you can submit photocopies and can produce the original at the time of evidence. But judge can ask you to file originals at the time of cognizance. There is no ready made performa but your facts should match with notice given.
