Time Period Calculation

# Dear Sir/Madam, I want to ask query that if a person is convicted in IPC 306 and punished for five years jail then how much time period he has to spent in jail? two and half year according to day and night or more?

day and night are not counted seperately.
he will have to undergo full sentence unless acquitted/modified by appellate court
according to jail manual he will get remittence of certain days in his sentence.

Mr. Deepak Kumar is right. A convict is entitled to remission under various heads depending upon his behaviour.

He has to under go complete 5 years but in practice the State Government releases him within 2 or 3 years as the Government has such powers. It depends upon his good conduct and so many other facts.
