Transfer of property

(Querist) 04 March 2009 This query is : Resolved 
Dear Sirs,

A person died intestate by leaving a plot and only a son. How the plot should be transferred from the father's name to son's name, in the following two conditions? Whether he has to approach the court of law or only revenue authority to get it transferred in his name.

(a) The subject property is the self acquired property of the father.

(b) The subject property is the ancestral property.

Kindly also advice me that the person, who died intestate has two sons and three daughters and how the property can be transferred to his legal heirs.

Please inform me which sections and which Act, I have to refer to get clear idea about this aspect.

just give an application to the concerend authority to change the khata of the plot in to the name of the son or to make kahta in the joint name i.e., of son and two daughters.
it is a simple procedure

Just file an application to the concerned authroites to enter the name of the surviving members of the deceased along with survivors certificate.

dear prabhakar,
you have not mentioned, whether they are hindu?
if they are hindu, it is self acquired or ancestral,in case of only son, he get the total property on his name through revenue authorities. in case they are 2 sons and 3 daughters, each gets 1/5th share out of it.
for further advice, you need to elucidate the brief or to refer the indian succession act or hindu succession act 2005.
